The Civil Police analyzed the images of a video showing the singer’s 7-year-old son Gusttavo Lima comes from Andressa Suita driving a car inside a condominium in Goiás According to the police, there was no violation of the Brazilian Highway Code (CTB) or the Penal Code. The child appears next to his 5-year-old brother, who is standing in the passenger seat, and even sticks his head out of the sunroof.

According to the police, after analyzing the images and the circumstances of the scene, it was concluded that there was no crime or violation of any kind.

“The Civil Police of Goiás, through the Bela Vista Police Station – 2nd DRP, clarifies that, after analyzing the images and circumstances of the place where two children are shown allegedly driving a vehicle on private property, not open to traffic, they concluded that there was no violation of the Brazilian Highway Code (CTB) or the Penal Code,” reads the note sent to Terra.

The Department of State Transit of Goiás (Detran-GO) issued a statement rejecting the video. A request was made to the police to investigate the conduct of Gusttavo Lima and Andressa Suita, since the action could encourage others to do the same and cause incidents.

In the video, the couple’s eldest son, Gabriel, appears to be driving the car. In addition to him, Samuel, his brother, is sitting on the seat and sticking his head out of the sunroof. In the caption, the boys’ mother wrote: “7 or 18?”

What does the Brazilian Highway Code say?

Because the accident occurred on private property, traffic authorities do not have the ability to monitor it. If it were on a public road, Andressa would be committing at least three traffic violations:

  • Child seat requirement for children up to 10 years old: very serious violation, with a fine of R$ 293.47 and seven points on the license;
  • Entrusting the driving of the vehicle to a person without a National Driving Permit (CNH) or driving permit: a very serious offence, with a fine of up to three times the amount foreseen and the possibility of withholding the driving licence.
  • Allowing, entrusting or transferring the driving of a motor vehicle to an unqualified person [ou que] he is unable to drive it safely: fine and imprisonment from six months to one year.
