Defense blames media and fans for Deolane’s return to prison: ‘It ended up destabilizing her’

On Wednesday 11, Deolane Bezerra’s defense filed a new request for habeas corpus with the Superior Court of Justice (STJ). The measure was adopted after the Court of Justice of Pernambuco (TJ-PE) decided to maintain the influencer’s preventive detention. Deolane was arrested again for violating one of the conditions imposed by the court, which established that she should not make public statements.

The defense argued that both the press and the influencer’s fans contributed to her emotional shock when she left the Bom Pastor women’s penal colony, in Recife.

“When leaving the prison, the patient immediately informed the crowd that she could not speak; however, the harassment around her was excessive, which ended up destabilizing her and then she actually spoke, without asking anyone to tell her story who felt wronged,” the lawyers explained.

The defense statement refers to the fact that the influencer was carried by her fans when she was released last Monday, 9, before returning to prison. There was great confusion that day, with press vehicles and spectators waiting at the prison entrance.

Daniele Bezerra, Deolane’s lawyer and sister, said she could not speak. “She was silenced by the Court of Justice, they prohibited her from speaking,” the relative said. At the time, Deolane ignored her sister and answered questions from the press and fans. “There is not a single piece of evidence! This is a criminal arrest, there is no evidence against me. Abuse of authority by the police chief Paulo Gondim. I thank all the fans, none of them will regret it,” she said.

Deolane Prison

Deolane was subjected to a custody hearing this Wednesday and her preventive detention was maintained by the TJPE. She was taken to the women’s penal colony of Buíque, in the interior of Pernambuco, this Tuesday 10, after her house arrest was revoked.

At the moment, according to a note released by the Court, his preventive arrest warrant is being analyzed by the custody court, where the formal aspects of the arrest, such as the legality of the execution of the warrant, have been verified.

The lifting of house arrest was communicated early Tuesday afternoon to the 12th Criminal Court. Deolane had benefited from a habeas corpus granted by the Supreme Federal Court (STF), in 2018, which replaces preventive detention with house arrest for pregnant women, breastfeeding women and mothers of children up to 12 years old or persons with disabilities. The entrepreneur is the mother of an 8-year-old girl.

In addition to her, Maria Eduarda Filizola, wife of Darwin Henrique da Silva Filho, owner of Esportes da Sorte, and Marcela Tavares Henrique da Silva Campos, Darwin’s sister and partner, also benefited from the right.

But, according to TV Globo, Deolane did not comply with the two precautionary measures imposed by the Judiciary. She could not speak publicly through social media, the press and other media, which was done as soon as she was released from prison, on Monday 9.
