The decision was issued on Wednesday (04), by the judge Mario Cunha Ointo Filho, who reiterated the full validity of the previous sentence and declared the lack of errors, contradictions or omissions that justified any type of revision.

Both requests have been formally accepted regarding their presentation within the legal deadline, being considered promptly. However, they were denied on merits. The magistrate stressed that the type of appeal used – embargo of the declaration – does not serve as a tool to modify the content of the sentence, but only for specific clarifications.

Divergence on the interpretation of the fine

The main controversy between the parties revolved around the application of the contractual fine. The influencer claimed that the decision determined the reduction of the penalty to 30% of the original value, which would correspond to R $ 1,560.

On the other hand, Allan Jesus claimed that the magistrate had decided only by deducing 30% compared to the total amount, which would have maintained the debt around R $ 3,640,000. Both interpretations were ignored by the judge, who maintained the final value of the sentence as previously entered into.

Financial determinations imposed to influencer

The original sentence requires Iran Ferreira to pay the amount of R $ 5,052,986.43, corresponding to the contractual break, more interest, corrections and allowances for moral damage. After applying a 30%discount, the amount to be paid became $ 3,200,000.

The influencer should also completely reimburse all the amounts invested by Allan Jesus and the Asj Consultoria Company, as well as the coverage costs with their family support.

In addition, the payment of R $ 120,000 was stipulated as damage to the damage caused to the former entrepreneur, due to the negative exposure on social networks. Despite the defeat in the embargo, the process is still in progress and other types of legal resources can be used by the parties, provided that they are based on new legal bases.

Refused the agreement and difficulties for discharge

Before the new decision of the Court, there were attempts to resolve per agreement. In 2023, the influencer even offered $ 2.5 million to end the dispute. The proposal was rejected by Allan, who declared that the amount presented “does not correspond to the investments in his career and covers image losses”.

In fact, the Court previously authorized the violation of the secrecy of the Iran Ferreira bank and requested the monthly transfer of 30% of its entrances to the former industry, a determination that had not been accepted regularly.
