Simone Regina de Abreu Nunes, the 37-year-old motorcyclist hit by Lima Duarte in an accident that occurred in São Paulo almost two months ago, is seeking compensation of R$ 1.2 million for the moral damages of the 93-year-old actor. The action was filed Friday (11/28) in the state Court of Justice.
According to the trial, Simone requests an injunction for the Justice to guarantee the payment of R$ 5,000 a month. In her appeal, the motorcyclist claims that she is still unable to return to work after the accident. The requested amount will be used for the post placement surgery in the coming months and for treatment, according to Angelo Carbone, Simone’s attorney.
Lima Duarte’s team told the press that the actor “is the victim of slander and defamation, which will be proven in any judicial process”.
After the accident, Lima Duarte offered BRL 30,000 and a monthly allowance of BRL 465, which would cover the payment for a wheelchair and a hospital bed.
However, Simone regretted the settlement, which has not been officially filed, according to her lawyer. “She needed money, she didn’t work, she didn’t have license plates and she had a rented motorbike. She needed to eat,” said Angelo Carbone.
Lima Duarte’s team confirmed the negotiations between the parties, but did not acknowledge responsibility for the accident. “We have evidence that the agreement was paid and signed in a conscientious and amicable manner. It was made with the sole humanitarian purpose of helping the motorcyclist in her recovery period.”
In addition to the request for compensation, Simone’s defense also asked for the opening of a police investigation at the Public Prosecutor’s Office of São Paulo. In this complaint, the motorcyclist’s lawyers ask for the seizure of the artist’s documents, such as a driving license and passport. The accident caused by Lima Duarte occurred in Barra Funda, west of São Paulo.
