The Minas Gerais court has acquitted singer Eduardo Costa of the crime of embezzlement in a real estate deal involving his compatriot. The decision was published on Tuesday 7. The artist was accused of attempting to purchase, in 2015, a property worth R$9 million in Belo Horizonte, using as part of the payment a house on the edge of the Lagoa de Furnas , in the Capitol. (MG), subject to expropriation by the Federal Public Ministry since 2013.

In the appeal, the public prosecutor stated that Eduardo Costa and a partner omitted the irregular situation of the property in Capitolio. At the time, the house was the subject of a foreclosure action, brought by Furnas Centrais Elétricas, and of a Public Civil Action for Compensation for Environmental Damage, by the State Deputy, who proposed the removal of the buildings in a strip 100 meters from the shore of the Furnas Lagoon.

The owners report that they were not aware of the situation of the property and accused the compatriot of embezzlement, specifying that Costa acted ‘intentionally, deceiving the victims’ with his omission.

However, in the decision of Judge José Xavier Magalhães Brandão, of the 11th Criminal Court of Belo Horizonte, it was highlighted that the sellers of the property in the capital of Minas Gerais and their lawyers were aware of the situation of the property in Furnas, after have collected the documents to complete the negotiation.

“By consulting the registration of the property given in payment, the existence of a collective judicial application was verified, which concerned the pending construction within the limit established by Furnas”, underlined the magistrate. Witnesses also told the court that ownership information in Capitolio was public.

During the trial it was also shown that the property that would be purchased by the singer, in BH, had debts of R$ 1.5 million with the Caixa Econômica Federal at the time of the sale, as well as labor and civil lawsuits on behalf of the sellers and their companies. According to the judge, “the need for a rapid transfer of the assets was evident, before it became free and clear on behalf of the victims, and a possible seizure of the assets was possible.”

Judge José Xavier further stated that, in the case of a negotiation involving such huge financial resources, “the least that can be done is to be well aware of the facts that exist in the region and the problems that may involve the property.”

“Since the offended people were duly notified by a qualified person, the accusation of ignorance of their existence does not tally with the evidence produced in the case”, concluded the investigating judge, acquitting Eduardo Costa at first instance. The action can still be appealed.

The compatriot’s partner accepted the proposal of conditional suspension of the trial, a service offered by the Prosecutor’s Office so that the accused respects the conditions imposed by the Court and the sentence was extinguished, in a trial celebrated in April, so the trial began to run only against the artist.
