Singer Amado Batista has been convicted of moral damages in a lawsuit brought by a couple of fans, who rioted over the surprise cancellation of a show. The case took place in August last year, in Sao Paulo.
For the occasion, the singer’s fans bought plane tickets from Juazeiro do Norte to the capital São Paulo, where the event was to take place at the Clube Nacional Vila Vivalde. The tickets cost around R$100 each, but in addition to these expenses, the couple also made a song to be shown at the show, which would have an exclusive request for the idol.
Hours before the start of the show, the private company Jaqueline Suriani Macrineu Eventos – EPP announced that the singer would not perform the show, without going into more detail about the cancellation.
The couple’s nightmare didn’t end there. The two turned to the court asking for the conviction of Amado Batista with the company and asked for the payment of the sums disbursed, equal to R$ 2,968.66.
The couple, who filed the gratuity benefit of justice, also requested compensation for moral damages in the amount of R$ 30,000. The claims were granted in court and the defendants must be held liable for the damages.
It is worth noting that Amado Batista even presented his defense when he was quoted in the lawsuit. The artist claimed his passive illegitimacy, as the show was canceled due to non-payment of the fee by the 24th of that month. He added that the damage was caused solely by a third party.
However, justice understood that the show was postponed due to the singer’s non-attendance, as it was not rescheduled for another date. The justice also held that he and the company should return the sums spent to the couple.
With the conviction, the artist and the company will have to pay R $ 5,000 to each plaintiff, in addition to another R $ 2,900 related to the couple’s total expenses. The amount must be accompanied by the due monetary restatement.
