Approved in September 2022, Law 14.443 modifies the rules for carrying out sterilization procedures in men and women
As of March 5, some changes to the Family Planning Law will come into force. Approved in September 2022, Law 14.443 modifies important aspects relating to procedures such as tubal ligation and vasectomy. With the new legislation, men and women can request and carry out the procedure without the prior authorization of their spouse.

In addition, the minimum age for carrying out operations has been changed. Previously, it was necessary to have 25 years or two children alive. It is now possible to apply for sterilization at the age of 21. In cases where the patient has two living and younger children, both surgeries can also be performed.
The change is considered a win in the female reproductive right. Although the law also includes male surgical sterilization (vasectomy), this amendment will facilitate access to this family planning measure.
So the main changes are:
- age for tubal ligation or vasectomy increased from 25 to 21;
- the existence of two children continues to be a parameter for the procedures, however, even if the patient is younger (eg, 18 years old), the sterilization intervention is assured;
- the consent of the spouse is no longer necessary for the execution of the intervention;
Other changes to the law
Another change incorporated into the Family Planning Act has to do with the implementation of tubal ligation. Before the law 14.443 it was not possible to carry out sterilization in other surgeries, such as childbirth or abortion.
