RIO – A Civil police has opened an investigation to investigate whether a woman had a perforated intestine during a liposuction carried out by Dr. Alberto Birman, at Hospital Barra Plástica, in Barra da Tijuca, in the west area of River, last month. The report was made at the 16th DP (Barra da Tijuca), which investigates the crime of culpable personal injury (without malice). Due to the serious state of health of Cássia Correa Avelar, 59, the patient was transferred to the Marcílio Dias Naval Hospital, in the north area.
According to the carabinieri, an inspection has already been carried out clinic where the liposuction was performed, together with the Health Surveillance agents. The professionals in charge of the clinic and the doctor Alberto Birman have already been notified to provide clarifications.
The family said the liposuction was performed on March 15 and that the surgery took seven hours. When Cássia returned from surgery, she began to complain of feeling a lot of abdominal pain. She ended up spending the night at the clinic for observation, on the recommendation of Nicole Birman, the surgeon’s daughter, who would also participate in the procedure.
In a statement to the inquiry, João Marcelo, Cássia’s husband, said that no more complex examinations were carried out at Barra hospital because the unit did not have ultrasound or tomography equipment. According to him, since the woman didn’t get better, she started charging the medical team for more forceful action.
On the 17th, two days after the procedure, she was transferred to Marcílio Dias, where a tomography confirmed intestinal perforation. Also according to her husband, Cássia contracted an infection, which ended up aggravating her condition. By note, the Navy’s health unit reported early Friday evening, the 14th, that the patient’s condition is stable.
The Rio Regional Council of Medicine (Cremerj) informed, through a statement, that “the practitioner does not have a specialty qualification record (RQE) registered with the council in any specialty.” Also in the Regional Council of Medicine of São Paulo (Cremesp) there is no registration of specialties. According to the Brazilian Society of Plastic Surgery website, he is also not registered as a member. Their daughter, Nicole Birman, appears as an “Aspirant in Training Member”.
Qualification
The doctor’s attorney, Lymark Kamaroff, told the paper The day that the surgeon is highly skilled and experienced, having successfully performed numerous plastic surgeries throughout his career. Again according to the lawyer’s explanations to the Rio de Janeiro newspaper, “there is no causal link” between the occurrence suffered by the patient and the hospital service.
Finally, Kamaroff said that surgical complications can occur and that, therefore, all patients sign a consent form, given the possibility of an adverse event occurring.
