This year marks the 14th anniversary of the Parental Alienation Law (12.318/2010), a milestone in the protection of children’s rights. This action aims to ensure a sensitive and effective approach, giving priority to the well-being of the children and parents involved.
Feeling of abandonment
After divorce, the issue of custody does not only concern the child, but concerns the breaking of emotional ties, generating a harmful feeling of abandonment and, consequently, can lead to so-called Parental Alienation. In this context, the balanced and affectionate presence of both parents in the lives of their children is essential for their psychological health.
Currently, judges increasingly intervene with the commitment of a psychological and biopsychosocial evaluation carried out by a multidisciplinary team whenever there are suspicions of parental alienation practices, in order to identify its onset. These assessments also aim to determine whether the child is suffering from the consequences of acts of parental alienation, offering an in-depth and well-founded diagnosis that serves as the basis for judicial decisions.
