According to Júlia’s lawyer, Leandro Furno Petraglia, it is not an obligation for companies to bring animals on flights, and the company can define its own rules for traveling in the cabin. However, the rules are often very restrictive, due to size, weight or species, as in the case of Júlia.

“In Júlia’s case, like many other clients who see a therapeutic purpose in the animal, given that it is essential to maintain calm and a good flight, they end up looking for its rights to be able to guarantee it, like other pathologies, such as blindness and deafness already provided for by law, the right to bring a support or service animal on board the aircraft”, explains Leandro to Earth.

The reason for the trip itself was the well-being of Kira, who needed to undergo a consultation with a doctor specializing in her kind, in São Paulo. Fearing that the animal might pose some health risk, the student decided to file a court order to ensure the animal’s travel in the plane cabin.

Judge Alessandra Alves de Mourão, however, gave a favorable opinion, establishing that the animal be transported inside a suitable box or cage, following all the specifications indicated by the airline, “so as not to jeopardize the tranquility and safety of the flight, and not if the applicant is required to scrupulously comply with all instructions relating to transport, in addition to paying the relevant fares”.

After the Court, Júlia embarked from Goiânia (GO) to São Paulo last Tuesday, the 23rd, and returned on Thursday the 25th. Leandro considered the decision a step forward. “It is the Judiciary that responds, filling the gaps that, unfortunately, the Legislature has not yet managed to fill and that the Anac persists in not filling,” he said.

“She [a Anac] understands that each airline should work and compete in the animal transport market, specializing by species, but, in practice, they all take their bodies away and there is room for an essential service that is not provided. I view decisions like these with great optimism,” she explained.

Death of the dog Joca

This week, 5-year-old dog Joca died after being sent to the wrong destination, forcing him to remain on the plane for nearly eight hours. The lawyer sees the situation as a sad example of the lack of safety in trunk transportation.

“We hope that the repercussions of the case [da Júlia] It can make airlines and ANAC understand that the structure proposed today, of a free business market, is incompatible with what is expected from safety. Today there is a new culture of the role of the animal in the family, the animal is more than just an animal that was outside the home, today it is part of the family,” he explains.
