Former athlete sentenced to 9 years for rape in Italy
This Wednesday, Robinho’s defense attorney, Dr. José Eduardo Alckmin, handed over the player’s passport to the Superior Court of Justice (STJ).
Robinho’s lawyers went to court on March 23 to volunteer the document. The day after, then, the minister Francisco Falcão ordered the delivery of the passport and granted a term of five days, while the Justice evaluates Italy’s request that it discount the nine years in prison for rape in Brazil.
Last week, the court case rapporteur denied a request by the former Santos player’s defense to summon the Italian government to provide a verbatim translated copy of the case. Francisco Falcão has also urgently established that the player be summoned to present opposition to the approval request and reopened the 15-day deadline for the deed.
Robinho was tried in the third and last instance by the Italian Justice for more than a year. In November of last year, his extradition was even requested, but the refusal took place by the Ministry of Justice of Brazil on the basis of article 5 of the Federal Constitution, which prohibits the extradition of Brazilian citizens.
Thus, the solution found by the Justice of Italy was to request the execution of the sentence in Brazil. At the end of February, the Federal Prosecutor’s Office (MPF) told the court that there was no restriction on serving his sentence in the country for a crime for which he had been convicted in Italy.
The case took place in 2013 in Milan. According to the sentence, Robinho and five other friends raped an Albanian woman, and he and Ricardo Falco were convicted. The other three men left Italy during the investigation and were not prosecuted. The penalty is nine years’ imprisonment, finally imposed in January 2022.
