The National Inspector of Justice, Minister Luis Felipe Salomão, has ordered a lightning inspection of the 13th Federal Court in Curitiba, the Lava Jato Base, and the offices of the judges of the 8th Federal Regional Court College of the 4th Region , responsible for , secondly, by the processes of the operation. The works will be carried out between this Wednesday 31st and Friday 2nd.
The investigation – technically called a “fix” – will be coordinated by judge Otávio Henrique Martins Port. Federal Judge Carlos Eduardo Delgado, of the Federal Regional Court of the 3rd Region, and Judge Cristiano de Castro Jarreta Coelho, of the São Paulo Court of Justice, will join the commission. In determining the verification, Salomão mentioned the existence of disciplinary complaints against the magistrates working in the departments.
Clashes
Standoffs involving the 13th Court and TRF-4 have become frequent with the case of Rodrigo Tacla Duran. A lawyer listed as a former Odebrecht operator, he had his preventive detention order revoked by Judge Eduardo Appio, who had been dealing with Lava Jato since February and is now removed from the 13th Court. Tacla Duran accuses former judge and senator Sérgio Moro (União Brasil-PR) and former coordinator of Lava Jato at the Public Prosecutor’s Office Deltan Dallagnol – elected deputy by Podemos-PR, but impeached by the Superior Electoral Court – of extortion (TSE).
Judge Marcelo Malucelli issued an order that was disclosed by TRF-4 as reinstating Tacla Duran’s pretrial detention. Subsequently, the judge resigned as Lava Jato’s speaker in court. Malucelli is the father of João Malucelli, companion of Moro’s wife, MP Rosangela Moro (União Brasil-SP), in an office in Curitiba. The couple’s daughter is dating João Malucelli.
In the meantime, the phone call took place which led to Appio’s removal from the 13th Court of Curitiba, suspected of “threatening” João Malucelli. TRF-4’s investigation found that he was the author of the call. Appio tries to take the case to the National Council of Justice and hopes to regain command of the so-called Lava Jato Court.
Appio potency advice; Gabriela insists on the removal
Judge Eduardo Appio, removed from the 13th Federal Criminal Court of Curitiba, accuses the Federal Regional Court of the 4th Region (TRF-4) of bias and asks the National Council of Justice (CNJ) to take over the investigation of his case. Appio was suspended from office on suspicion of embarrassing the family of TRF-4 Judge Marcelo Malucelli.
Appio’s defense claims that former judge and senator Sérgio Moro (União Brasil-PR) helped send the case to TRF-4 for investigation. The lawyer representing Appio, Pedro Serrano, questions the impartiality of the Court pointing out that TRF-4 refused to file a lawsuit against Moro, then a judge, on the grounds that Lava Jato was “an unprecedented case (unique , exceptional) in Brazilian law”. For the defence, Appio was removed without any administrative disciplinary proceedings being opened, which conflicts with the decision of the Federal Supreme Court.
Appio’s replacement in the 13th Court, Judge Gabriela Hardt granted the request to move to Florianópolis. The application will be reviewed by the TRF-4 Board of Directors. If accepted, a new judge will be appointed to take over the remaining Lava Jato shares.
