The Chamber declares the loss of Dallagnol’s mandate after the conviction by the TSE

The Board of Directors of the Chamber of Deputies unanimously declared on Tuesday the loss of the mandate of deputy Deltan Dallagnol (Podemos), former chief prosecutor of the Lava Jato operation task force in Curitiba, three weeks after his revocation by the Tribunal superior constituency ( EST).

According to a source linked to the Speaker of the Chamber, Arthur Lira (PP-AL), the leaders of the Chamber would not have moved to make any move to try to save Dallagnol, considered uninterested in the political class due to the work of Lava Jato.

According to Agência Câmara, the appointment of the replacement who will fill Dallagnol’s vacancy in the Chamber for Paraná still depends on a court decision, as there is a dispute between Itamar Paim (PL) and Luiz Carlos Hauly (Podemos).

In an official note, the Chamber of Deputies explained that in the event of forfeiture of the mandate determined by the Electoral Justice “there is no decision on the merits or judgment of the Plenary of the Chamber”.

According to the TSE understanding, Dallagnol would be ineligible at the time of applying for candidacy registration for last year’s elections under the Clean Record Law.

The legislation provides for the ineligibility for 8 years of members of the Public Prosecutor’s Office and of the Judiciary who have been placed on official retirement, who have lost their office with a sentence or who have requested revocation pending administrative disciplinary proceedings.

The reporter of the case, Minister Benedito Gonçalves, understood that Dallagnol’s request for expulsion from the Public Prosecutor’s Office was aimed at “frustrating, in a manifest abuse of rights, the impact of the ineligibility regime”.

The unanimous decision of the TSE took place in the context of the appeals presented by the National Mobilization Party (PMN) and the Brasil da Esperança Federation (PCdoB, PT and PV) against the sentence of the Regional Electoral Court of Paraná (TRE-PR) which had granted the registration of the politician’s candidacy.
