CNJ Retires Judge Over Selling Sentences

The plenary assembly of the National Council of Justice (CNJ) fired ex officio the judge of the Court of Justice of Tocantins (TJ-TO) Ronaldo Eurípedes de Souza, accused of selling judicial decisions. The administrative sanction – the most severe inflicted on the toga envisaged by the organic law of the judiciary (Loman) – entails the perception, by the magistrate, of salaries commensurate with length of service.

Even though he was out of office for about three years, Souza continued to receive his salary. In May, for example, according to Tocantins’ TJ Transparency Portal, he received subsidies worth R$39,711.96—or R$26,600.72 net.

Reported for the crimes of passive corruption and money laundering, the judge has ceased his activity since 2020 by order of the Superior Court of Justice (STJ).

FALSE STATEMENT

The day before yesterday, the CNJ judged the administrative disciplinary proceeding against the judge, which was drawn up on the report of councilor Sidney Madruga. According to the adviser, the magistrate “benefited a group of lawyers”.

Madruga stated that the judge “was part of a criminal plan to obtain economic advantages through the intermediation of sentences, demonstrating distortion of the judicial activity, in favor of illicit private interests”.

“The violation of the ethical principles of independence, impartiality, transparency, professional and personal integrity, dignity, honor and decorum, essential for the exercise of judicial activity”, highlighted the rapporteur in the sentence.

Ronaldo Eurípedes de Souza was denounced before the STJ by the Attorney General’s Office (PGR) in 2021. The indictment claims that the judge acted favorably in the trials of Costa Esmeralda Lotting and Compagnia Sul Americana de Montagens (EMSA), in exchange of R 1.3 million dollars in bribes. The amount, according to the complaint, would have been laundered through simulated contracts.

On the occasion, Deputy Attorney General Lindôra Araújo also requested that the judge be removed from office. According to Lindôra, the magistrate “commercialized his public role, issuing decisions against payment of undue advantages, doing so in collaboration with some lawyers”. At the time of the complaint, Souza’s defense classified the allegations as inconsistent.

The report contacted the judge and representatives of the Costa Smeralda Subdivision and the Compagnia Sul Americana de Montagens (EMSA), but there was no response until 9pm yesterday.
