The government expects to receive in 2024 around 10% of the sums that will be judged by the Board of Tax Appeals (CARF) during the year, said the Minister of Finance, Fernando Haddad, in an interview with the Canal Livre program , at the Bandeirantes Network, highlighting that the proportion is in line with the historical average.
The value of the revenue expected in the 2024 draft budget with the CARF processes is 54 billion reais, but Haddad specified that the estimate is that the municipality will bring cases to trial for between 500 and 800 billion reais, suggesting that the effectiveness of the revenue could be even greater.
“We are counting on 10% of the processes expected for next year. Because we have a stock of 1,300 billion reais. We want to judge between 500 and 800 billion reais by next year. Why is this possible? Because since we have lost the quality there, in the Bolsonaro government, the processes in the CARF stopped,” he said. “Carf’s story is that 10% of assessed values enter the Treasury’s cash flow each year.”
This year the government managed to approve a new legislative change in Congress to resume the decisive vote in the CARF: that is, in the event of a tie in the collegiate decisions, the decisive vote falls to the Executive. With this, Haddad says, the votes will be released.
The minister revealed that there are now more than 100 thousand processes in the CARF, but only 126, of large companies, correspond to 600 billion reais. The government’s bet is that, with the legislative change, which has also introduced benefits for companies that close cases without judicial review, there should be a quicker solution.
“The CARF law offers companies that are ultimately convicted by the quality vote a very large advantage, namely a reduction in fines and charges. We understand that this value (of sentences in 2024) could even be exceeded,” Haddad said.
The minister even compared the CARF modification to a “Desenrola” for businesses, citing the program created by the government to renegotiate the debts of the low-income population with reduced interest and expenses.
“Carf is already a Desenrola. Not only has it restored the quality vote, but it has also created procedures that were not foreseen by the legislation. Tax litigation will decrease significantly”, bets the minister.
