The Superior Electoral Court (TSE) begins judging this Tuesday (24) three appeals against the conduct of the former president Jair Bolsonaro (PL) during the celebrations on September 7, 2022. The session is scheduled to begin at 7:00 pm. The hearings on the 26th and 31st of this month were also reserved for the hearing of the case.
In actions, the PDT and the senator Soraya Thronicke (Podemos-MS) accuse Bolsonaro of using the celebrations of the Bicentenary of Independence to promote his candidacy for re-election in the elections held in October last year.
According to the accusation, Bolsonaro used the day of September 7 to carry out electoral acts, using the platform and the official broadcast of TV Brasil to invite supporters to vote for him. For the party, the former president used the “public machine for its own benefit”.
As punishment for the alleged acts of irregularities, the TSE was asked to make them ineligible and impose a fine. The punishment can also affect the general Braga Nettovice president on Bolsonaro’s ticket.
If convicted, Bolsonaro could be ineligible for eight years for a second time. However, the eight-year term continues to apply depending on the first conviction and will not be counted twice.
In June this year, the former president was sentenced by the electoral tribunal to eight years of ineligibility for abuse of political power and misuse of the media. Bolsonaro held a meeting with ambassadors in July last year at the Palácio da Alvorada, where he attacked the electronic voting system. Braga Netto was acquitted at trial for not participating in the meeting.
Defence
In the preventive defense sent to the TSE, the lawyer TarcÃsio Vieira de Carvalho argued that the appeals should be rejected by ministers. According to the defense, Bolsonaro did not use the official platform to campaign.
“Only after the end of the official agenda, with the de facto and de jure end of the procession, did the first person under investigation, without the presidential sash, walk towards the public and speak, as a candidate”the defense said.
Last week, the TSE rejected three actions in which Jair Bolsonaro was also accused of abuse of political power in the 2022 election campaign.
