Furthermore, they must apply actions that prevent the return of false advertising on the topic and present a detailed transparency report on the measures taken, under penalty of a daily fine of R$ 150,000 in case of failure to comply with any of the determinations.

The precautionary measure was imposed by the National Consumer Secretariat of the Ministry of Justice (Senacon), which also initiated administrative sanction proceedings, within the Department for Consumer Protection and Defense (DPDC), to investigate the conduct of two companies. The deadline available to companies to defend themselves in this process is 20 days.

“Once again, scams and fraud against consumers are being perpetrated across digital platforms. To make the situation even more serious, scam and fraudulent content is not simply delivered by third parties, but driven by the platforms through paid advertising, which is transformed into a remuneration for content. suppliers”, underlines the Senacon in the order published on Wednesday 1 in the Official Journal of the Union (DOU) in which it informs companies.

The fraudulent content concerns the Voa Brasil Program, a federal government initiative undertaken by the Ministry of Ports and Airports, which will aim to make airline tickets available at affordable prices for certain segments of the population, in order to democratize access to tourism. “The Program hasn’t even been launched and its participation rules haven’t yet been defined, so the benefits that come from it haven’t yet been made accessible to the public,” he explains.

The Secretariat highlights in the document that scammers and scammers take advantage of the context of citizens’ expectations for another “inclusive program” to seek undue financial benefits from consumers and jeopardize the soundness of government action. “The ploy consists of requesting data and payments from the recipients of the scam, through monetized advertisements on the digital platforms of the economic conglomerate Meta Inc. and Google Brasil, which generally redirect consumers to the sites where the frauds will be carried out, and deceiving consumers, who believe they are taking active action to benefit from the Program.”

The body linked to the Minister of Justice, Flávio Dino, also underlines that this type of action not only generates financial losses for the consumer, but also causes “a serious compromise of the State’s investments in the implementation of public policies” and also compromises credibility and trust of the traditional press, “since many of the tricks are spread through audiovisual montages and manipulations of legitimate journalistic content”.
