According to the agency, the initiative does not respect the constitutional principle of equality in access to public education
A Attorney General of the Republic (PGR) appealed Federal Supreme Court (STF) against the inclusion of students from military schools in the quota system of federal universities and federal secondary technical education institutions. The rapporteur of the measure is the minister Alexander de Moraes.
The PGR claims that the Quota Law was established as a positive action policy to encourage the entry of people from vulnerable social groups into federal public institutions of higher and secondary technical education. The purpose of the system, therefore, is to reduce inequalities, according to the PGR.
According to the body, the inclusion of military school students in the quotas violates the legislation itself, since these institutions are not accessible to all on equal terms, as they give priority to the enrollment of military dependents and are not free. The Attorney General’s Office argues that, according to the STF’s own interpretation, military universities are institutions Sui generis.
Another justification for the action presented by the PGR is that military schools have an excellent level of education, which allows their students to enroll through a broad competition, on equal terms with other candidates in the selection processes.
As the PGR states, the inclusion of students in the quota system occurs through the opinion of the Attorney General of the Union (AGU) which gives military schools the same legal status as public schools. The measure was approved by the Presidency of the Republic in 2020, during the Jair Bolsonaro government.
