The changes promoted by the Pension Reform alter some aspects of retirement for the nursing sector. The special pension can be granted to anyone who demonstrates exposure to agents harmful to health.

After implementing the Social security reformthe special retirement request for healthcare workers presents different conditions for these workers, depending on the period of work and the date of contribution to social security.




Nurses, doctors, dentists and other healthcare workers can have the advantage of retiring quickly. This type of retirement can be contemplated for all professionals who work exposed to agents harmful to health.

For taxpayers up to 13.11.2019, the rule of 25 years of special activity and 86 points (sum of age, with special work time and contributions) applies. For insured persons after 11.13.2019, the permanent rule of 25 years of special activity and 60 years of minimum age applies.

Special pension calculation

The Social Security Reform also changed the calculation of the value of the special retirement, which now includes two implementation methods. For the insured who has completed 25 years of special activity up to 12/11/2019, the calculation will be the total value of the average of his highest contributory wages of 80% as of July 1994 and without social security factor.

The rule valid after the Reform provides that insured persons receive 60% of the average contributory wages starting from July 1994 – i.e. from when the insured person started collecting for the INSS – plus 2% for men for each year over 20 years of contributions or the same amount for women for each year that exceeds 15 years of contributions and without a social security factor.

Beschizza underlines the importance of paying attention to the various transition rules. “The changes could even be more beneficial for some workers nearing retirement in 2019.”

“In some cases, the pension amount may exceed 100% of the initial monthly income (RMI) or the social security factor may not be applicable, depending on the applicable transitional rule,” reminds the lawyer.

Change in the granting of the special pension

Special retirement of healthcare workers continues to be a legislative work topic in the country. The Chamber of Deputies is examining the Draft law 1665/22which guarantees a special retirement to healthcare workers already receiving social security who continue to work.
