The text approved by the Senate also modifies the rules for the progression of the sentence regime. If the issue becomes law, the benefit can only be granted to those with “good prison conduct”, which must be certified by the prison director and by a criminological examination based on criteria such as self-discipline, low dangerousness and common sense of the prisoner. of responsibility.
The proposal also provides for mandatory electronic monitoring of prisoners transitioning to semi-open and open regimes.
Currently, authorization is given to prisoners who have served at least one sixth of their sentence, in the case of a first conviction, and a quarter, in the case of repeat offenders. “Sayinhas” occur up to five times a year and cannot exceed a period of seven days.
Since 2018, around 34 thousand prisoners, on average, met the prerequisites that allowed them to access the right – which corresponds to 5.2% of the prison population held in physical cells in Brazil in June 2023, according to data from the 14th Penitentiary Information Harvest cycle. About 4% of inmates did not return to prison after temporary release.
