Pietra Bertolazzi was fined R$30,000 for inciting hatred and lying against Janja during the election period
This Thursday (3/7) the TSE (Higher Electoral Court) fined Jovem Pan commentator Pietra Bertolazzi R$30,000. She was convicted of spreading false news about First Lady Janja da Silva during the 2022 elections.
Pietra Bertolazzi said in a comment that, “while you have Janja hugging Pabllo Vittar and smoking marijuana, doing who knows what, you have an impeccable woman who represents right, values, kindness, beauty: Michelle [Bolsonaro]”.
The phrase had a lot of repercussions during the elections and the Court understood that the comment was intended to damage the then candidate Luiz InĂ¡cio Lula da Silva. Therefore, the speech was framed as a broadcast of fake news and a hateful attack on the candidate’s spouse. TSE president Minister Alexandre de Moraes said Bertolazzi “practiced hate speech day and night” in a “blatantly negative campaign.”
Agenda on customs and sexism
Moraes said that by associating Janja with marijuana consumption and criticizing his relationship with singer Pablo Vittar, Bertolazzi had entered into customary arguments and, since the statement was made in an electoral context, he could be punished by the Court.
“In offending the wife of the then candidate Lula, now First Lady, the offense was based on the ideas of an agenda of customs and incitement to hatred precisely to favor a candidate [Jair Bolsonaro]”said Alexandre de Moraes.
Minister AndrĂ© Tavares agreed that Bertolazzi’s statement was intended to target Lula, “even if indirectly”.
Minister CĂ¡rmen LĂºcia added that hate speech against women usually has a sexist aspect. “Hate speech is different between men and women. Against men, it is of a single nature. Against women, it is sexist, habitual, extremely violent, and cannot affect the family,” he said.
