Robinho is arrested in SP to serve a sentence for rape

Sentenced in Italy to 9 years of detention, following a decision by the STJ, the former player was taken to the Tremembé penitentiary, in the interior of São Paulo, known for receiving prisoners from cases of great turmoil. former player Robson de Souza, known as Robinho, arrived in the early hours of this Friday (22/03) in the Tremembé penitentiary complex, in the hinterland of São Paulo.




He was arrested by the Federal Police (PF) on Thursday night in Santos (SP), after the Special Tribunal of the Superior Court of Justice (STJ) had decided the day before, by 9 votes against 2, to serve his 9-year sentence prison for rape. The sentence was defined by the Italian Court, where the former player was convicted in three cases of gang rape which took place inside a nightclub in Milan in 2013.

The arrest warrant was issued by the Fifth Federal Court of Justice in Santos.

In February 2023 the Italian government asked Brazil to ratify the decision of the Italian judiciary so that Robinho could start serving his sentence, even if in another country – since according to the Constitution Brazil does not extradite its citizens to serve a sentence issued by foreign authority.

“Prison of the Famous”

Last Thursday, the president of the STJ, Maria Thereza de Assis Moura, signed the authorization granted to the Federal Court to arrest the former player. To avoid arrest, the former player’s defense presented a habeas corpus request to the Federal Supreme Court (STF), rejected today with a single decision by minister Luiz Fux.

Known as P2 of Tremembé, the Dr. José Augusto César Salgado Penitentiary routinely welcomes inmates from cases of great social turmoil to ensure the safety and privacy of the inmates. For this reason the unit is also popularly known as the “prison of the famous”.

There the new inmates undergo a period of inclusion, in an exclusive cell, remaining in isolation for up to 20 days and sunbathing separately from the other inmates. After this adaptation time, Robinho will have to be transferred to a common cell.

Understand the case

The crime for which Robinho was convicted took place at the Sio Café nightclub in Milan and involved, in addition to the former player and his friend Ricardo Falco, four other Brazilians, according to information from the Milan Prosecutor’s Office. They left Italy during the investigation and were therefore not charged, but only named in the trial.

The victim, an Albanian woman living in Italy, declared that she knew the then player and some of his friends, and that she was in a nightclub on the night of January 22, 2013 with the group and two other friends. She would be celebrating his 23rd birthday.

After her friends left, the Brazilian and his friends, according to the victim, gave her alcoholic drinks which left her unconscious, unable to resist the sexual assault.

The player admitted to having had sexual intercourse with the victim, but denied that there had been sexual violence. Through recordings authorized by the Italian court, the Brazilian was caught uttering phrases such as “the woman was completely drunk”.

Robinho left Milan in 2015 after five years at the club. When the Italian press announced that he and other Brazilians were under investigation for sexual assault, he had already returned to Brazil, to play for Santos. Subsequently he also played in China, before joining Atlético-MG in February 2016.

In 2009, when playing for Manchester City, the player faced similar charges in the UK. The case, a sexual crime allegedly taking place in a nightclub in the city of Leeds, did not result in a conviction, but led, at the time, to the arrest of Robinho, who was released on bail.
