The measures aim to reduce the number of animal collisions on the Oswaldo Cruz Highway; DER says the bidding is ongoing
The Court of São Paulo rejected the appeal presented by the government of São Paulo and, on Monday 10th, confirmed the decision obliging the Department of Highways (DER) to reduce the speed limit and install radar on a section of the Oswaldo Cruz highway (SP-125), which connects Taubaté to Ubatubaon the north coast.
The public civil action was brought by the Public Prosecutor of São Paulo (MP-SP) with the aim of forcing the DER to adopt measures that seek to reduce the number of animals hit on the stretch of highway that crosses Santa Virginia. core of the Serra do Serra Mar State Park. The first instance decision was issued by the Single Court of São Luiz do Paraitinga and obliges the DER to reduce the maximum speed allowed between km 66 and 86 of the motorway from 80 km/h to 60 km/h. Furthermore, it establishes that DERs install new speed cameras, mainly at kilometers 67, 72, 74, 78, 79 and 85.
The state government appealed, but on the 10th the First Environment Chamber of the Court of Justice of São Paulo confirmed the decision.
In a statement, the DER specified that it will await official notification of the ruling to comment. However, he informed that since January the maximum speed on the mentioned stretch has been reduced from 80 km/h to 60 km/h and that five radars will be installed on the same stretch of motorway by the end of the year. A tender is underway, the department says.
The DER also specified that it had commissioned “a specialized consultancy study for the monitoring of local fauna and possible road accidents on the SP 125, from km 4 to km 94.5, in the municipalities of Taubaté, Natividade da Serra, Redenção da Serra , São Luiz do Paraitinga and Ubatuba. The study aims to verify the most appropriate mitigating measures, including the necessary engineering projects at critical points”.
