The board of directors of the National Electricity Agency (Aneel) approved on Thursday, in an extraordinary meeting, the amendment that extends the agreement signed between the Ministry of Mines and Energy and Âmbar Energia regarding the group’s thermoelectric plants contracted in 2021.
In a letter sent the day before, the director general of the regulatory agency, Sandoval Feitosa, informed the ministers of the Federal Court of Auditors (TCU) of the approval of the amendment and also made Aneel available to carry out further analyses of the case, such as new tests in the plants and other phases, and to suspend the agreement indefinitely “if the Court deems it necessary to have more time to examine its economic viability and convenience for consumers and compliance with the public interest.”
União e Âmbar Energia, part of the J&F Group, the holding company of brothers Wesley and Joesley Batista, reached an agreement in May to resolve the situation of the energy producer’s projects that won an emergency auction launched by the government in 2021, when Brazil was facing risks of rationing and blackouts.
The agreement was due to come into force on the 22nd of this month, but has been extended until August 30th.
The terms agreed between União and the Batista brothers’ company have been the subject of strong criticism and have yet to be analyzed by the TCU.
Under the agreement, Âmbar would have to pay about 1 billion reais in fines for delays in starting projects, but would still receive more than 9 billion reais in generation revenues, a figure significantly lower than previously contracted. 2021, but still current.
There is debate over whether this more expensive thermoelectric generation, contracted in the midst of the water crisis, is still really necessary for the Brazilian electricity system and whether it would not be in the public interest to simply terminate the contract.
