As of Friday 20, the Federal Police has arrested 36 candidates for the 2024 municipal elections with outstanding arrest warrants. The arrests occurred in the states of Minas Gerais, São Paulo, Paraná, Maranhão, Acre, Rio Grande do Sul, Sergipe, Roraima, Mato Grosso do Sul and Santa Catarina.

According to the PF, the arrest warrants include crimes such as drug trafficking, active corruption, promotion of illegal immigration, illegal possession of firearms, violent abolition of the democratic rule of law, and sexual crimes, as well as several cases of failure to pay child support.

Prisons have vetoed

Starting this Saturday, the 21st, none of the candidates for mayor or councilor in the 2024 elections can be arrested. The deadline runs 15 days from the filing of the complaint. The exception concerns flagrant cases. This guarantee is valid until October 8th. For the second round, the rule will come into force on October 15th.

This is a guarantee provided by the Electoral Code (Law No. 4,737/1965) so as not to impede or hinder the political right to vote and be voted for, as well as to maintain balance in the dispute between competitors. “In the event of arrest, the detainee will be immediately brought before the competent judge who, if he finds the detention illegitimacy, will loosen it and promote the responsibility of coercion,” says the law.

The rule aims to ensure the balance of the electoral dispute and the full exercise of electoral activities, as well as to prevent arrests from being used as a political strategy.
