Stellarblade vs. Star Blade
Stellar Blade developer Shift Up and Sony are being sued over the Stellar Blade name. The plaintiff, a Louisiana-based film production company called Stellarblade, claims trademark infringement and that its business is being damaged by Shift Up’s use of the name.
According to the IGNThe complaint was filed in a Louisiana court earlier this month by Stellarblade LLC and owner Griffith Chambers Mehaffey against Shift Up, Sony, and an unnamed insurance company that the plaintiff claims covers Sony Interactive Entertainment (SIE) for civil liability against the exact allegations made by Stellarblade.
In the lawsuit, the manufacturer and Mehaffey argue that the company has been in existence since 2010, providing “multimedia entertainment services” and that Mehaffey has owned stellarblade.com since 2006 and has been using it in conjunction with his work since 2011.
Mehaffey also stated that the game, formerly known as Project Eve, was renamed Stellar Blade in 2022, and sometime later, in January 2023, Shift Up registered Stellar Blade as a video game trademark. Then, in June 2023, Mehaffey registered his own trademark for Stellarblade, and after a month, he contacted Shift Up to cease and desist from activities involving the use of that name.
Mehaffey also says that his customers used to easily find information about his business, but now people who search for Stellarblade work on the Internet only find the Stellar Blade game. He also says that trademarks are “confusingly similar”citing the color schemes of both logos and the S.
Mehaffey is demanding that Shift Up and Sony be prevented from using Stellar Blade or any other similar name, as well as hand over all materials they have that contain Stellar Blade, so that Mehaffey and his company can destroy them. He is also demanding damages and attorneys’ fees.
At the time of publication of this news, Sony had not yet commented on the matter.
