The Regional Electoral Court of Rio Grande do Sul (TRE-RS), unanimously declared the ineligibility of Pablo Melo, son of the mayor of Porto Alegre, Sebastião Melo (MDB). The trial took place on the afternoon of this Wednesday 25. Pablo, candidate for councilor in the capital of Rio Grande do Sul, also saw the registration of his candidacy denied. The Court understood that the Constitution prohibits the candidacy of a relative of the chief executive.
Attorney Lucas Lazari, who represents PT city council candidate Jeferson Aguiar, author of the appeal, notes that there is only one exception in the Constitution to ineligibility due to family relationship: when the relative has an elective mandate and is a candidate for re-election. “Of these two criteria, however, Pablo meets only one, since he is a candidate for re-election as a substitute in office, thanks to the license of the current Cezar Schirmer, who occupies the City Planning Secretariat. Pablo, therefore, does not hold a mandate,” he said.
