Punters with money deposited in irregular betting (electronic betting companies) have eight days from this Tuesday (1st) to withdraw the amounts. From the 11th, the National Telecommunications Agency (Anatel) will remove access to approximately 600 pages that had not requested authorization from the Ministry of Finance to operate in Brazil.
The list of 199 brands authorized to operate in the country was published on Tuesday evening (1) by the Ministry of Finance. With the information the user is required to consult the list to check whether the site or company is present in it. Otherwise, the money is deposited on an irregular site and must be withdrawn to avoid causing losses to the bettor.
Until September 30th the user will be able to consult the companies that have requested authorization from the Ministry of Finance. The list is found in the ministry’s betting management system (Sigap). In total, 180 companies submitted 185 requests, of which 31 were filed on September 30, the last day of the deadline. The difference is that Sigap provides the company name and not the site brand, which often makes it difficult to consult.
Step by step
To withdraw money, the bettor needs to log in to the betting application or website. In this case, you need to click on the area where the balance appears and click on the withdrawal option. Next you need to confirm the amount to be withdrawn, in this case the total balance, and communicate the bank account to which the money will be sent.
You will have the option to receive your money via Pix or via available electronic transfer (TED). Transfers via Pix are more advantageous because they are instant and operate 24 hours a day, while transfers can only be made on working days and are not carried out at night or on weekends.
If the user requests a withdrawal and does not receive the money, they will need to contact the application support, before the country is permanently banned. If the balance is not deposited, your first option is to file a complaint with a consumer protection agency, such as Procon.
Fraud
If there is no response, the chances increase that the bettor has been the victim of fraud. In this case the process passes to the criminal sphere. The user will have to file a complaint and contact the Public Prosecutor’s Office, who will be able to identify refund requests for the same site and bring a collective legal action.
Even when going to court, bettors must be aware that most bets are foreign and have no legal representatives in Brazil. This makes it difficult to hold the company accountable and punish it. In any case, the advice is to contact the police and the courts as soon as possible to avoid the charges becoming invalid and the trial becoming statute barred.
The closure of the portals will be the responsibility of the National Telecommunications Agency (Anatel), in an operation similar to the closure of the activities of X, the old Twitter, which stopped functioning in the country at the end of August. According to the tender promoted by the ministry, companies that have not received or requested authorization to continue operating in the country will be banned.
Strict supervision
With the publication of the list of companies authorized to operate in the country, the Prizes and Betting Secretariat (SPA) of the Ministry of Finance will have the task of supervising the sequence of activities in coordination with Anatel, the Central Bank and the Ministry of Justice and Public Security.
It is worth specifying that the list is not definitive, considering that the companies left out can request authorization from the Ministry of Finance to operate. However, they will have to wait a maximum period of 150 days for the final release, which could only take place in 2025.
Before that, in December, the Treasury will have to publish a new list with the conclusion of the analysis of the documentation of the companies submitted this Tuesday (1st), checking whether they comply with the established standards.
