Improper use of clothing

Fashion designer Lucia Helena da Silva, owner of the Ropahrara Moda Exótica brand, has filed a court request to remove two clips of Anitta from YouTube. In September, the designer sued the singer and the C&A chain for improper use of the clothes she created.

Anitta allegedly inappropriately used songs created by Lucia in the clips for “Is That For Me” (2017) and “Vai Malandra” (2017), which has already exceeded more than 456 million views on YouTube. Poderosa also appeared in the clips of “No Meu Talento” (2014) and in the recent “Funk Rave” (2024) with alleged pieces by the designer.

Subsequently, some clothing items would have been used in campaigns promoted by the C&A brand, identified as productions of the company in collaboration with the designer Yasmine McDougall Sterea. The designer told the court that her copyright and intellectual rights had been violated.

Compensation

Lucia Helena asked Google, responsible for the video platform, to pay compensation of R$500,000 for moral damages, in addition to another sum to be established in settlement of the penalty for material damage. The action requires the immediate removal of the contents in order to ensure urgent relief.

The designer also requested compensation of R$ 1 million for moral and material damages on behalf of the Ropahrara company, which usually provides costume looks for soap operas, such as “Avenida Brasil” (2012), and the series “Pé na Cova ” (2013).

It is worth mentioning that the Marco Civil da Internet, established since 2014, establishes that YouTube cannot be condemned for content generated by third parties on the platform, but can be held liable if it does not comply with a court removal order.
