Bolsonaro says lawyers will appeal Moraes’ decision and denounce ‘persecution’

The STF denied, on Thursday the 6th, that the former president would go to Trump’s inauguration in the United States

Jair Bolsonaro (PL) said that his lawyers will appeal the decision of Minister Alexandre de Moraes, of the Federal Supreme Court (STF), which did not accept the request for the return of the passport made by the former president’s defense. He also claimed to be “a target of persecution” during an interview on the program Faroeste à Brasileira, on the Revista Oeste YouTube channel, on the afternoon of this Thursday the 16th.

“The passport issue is still in play. I have a team of lawyers who asked me not to go into the details of the trial, because there is still an appeal. So there is a lot to do and they don’t want my statement to take away the main focus on this episode,” he said.

Bolsonaro planned to go to the inauguration of the president-elect of the United States, Donald Trump, which will take place next Monday, 20. During the program, he stated that his wife, Michelle Bolsonaro, will be a confirmed presence at the house of the Republican leader inauguration despite his absence.

“It will have a very special treatment because of the consideration that President Trump has for me. A friendship built in two years. And it’s common, right, when you are in power to have your friends and when you leave power, 90% leave it goes, when they don’t turn their back on you. It didn’t happen to them. [Trump]. Everything he suffered there, I suffered here. Also the similarities between the shot that hit his ear and the stab wound I got here in the stomach,” he said.

The former president also said that since the election he and his supporters have faced “persecution and retaliation.”

Passport return denied

According to the STF decision, Bolsonaro’s defense did not present “any evidentiary document demonstrating the existence of an invitation addressed by the president-elect of the USA”, since the only evidence attached was the text of an alleged email which was allegedly was sent by a Trump aide.

Despite this, according to the decision, the minister continues to analyze the defense request, considering the recommendation previously formulated by the Attorney General’s Office (PGR), which advised rejecting the request because it was a trip of private interest.

For Paulo Gonet, Bolsonaro did not present sufficient reasons to justify the suspension of the precautionary measure. “The desired trip aims to satisfy the private interest of the applicant, which is not essential,” he defined.

Moraes’ decision continues to cite moments in which Bolsonaro publicly declared himself in favor of the escape of those convicted of the January 8, 2023 coups.

“There is no doubt, therefore, that, starting from the unanimous decision of the First Board [do STF]no change in fact occurred that justifies the revocation of the precautionary measure, as the scenario that supported the imposition of the ban on removal from the country, with the surrender of passports, continues to indicate the possibility of an attempt to evade the accused Jair Messias Bolsonaro, to evade the application of criminal law”, concludes the decision of Alexandre de Moraes.

As a result, this is the fourth time that the former president’s request to return his passport has been rejected.
