Unanimously, the Federal Supreme Court (STF) took the majority against the decision of the Chamber which would have suspended the criminal action of the plot of the coup of January 8.

Last to vote, Minister Cámen Lúcia presented his position on Saturday 10. He followed the position of Repartur, Minister Alexandre de Moraes, as well as his first classmates: Cristiano Zanin, Luiz Fux and Flávio Dino.

According to the Constitution, if the Court decides to have an action against the parliamentarians accused of crimes committed before the diploma – Ramagem did so in December 2022 – it is necessary to consult the congress for this.

Therefore, with the decision of the Chamber, the case would be limited to two crimes: qualified damage and against the equity and deterioration of overturned activities, linked to the documents of January 8. The others would have been excluded from the veto, as they would have been practiced before the diploma.

Moraes then voted for the partial suspension of the action relating only to the crimes attributed after graduation.

Zanin, in his vote, also agreed with the speaker. “Immunity does not apply to non -parliamentarians or infringements before graduation.”
