Accused of using identical texts in thousands of judicial decisions, the replacement judge Angelica Chamon Layoun He was fired by the office by Rio Grande Do on the Court of Justice (TJ-T). The measure was made official in the publication in Diário da Justiça on Monday (7) and results from internal disciplinary proceedings that analyzed his performances in the Cachoeira do Sul (RS) district.




According to the TJ-GRS, the magistrate used the same model of phrase in about 2,000 civil proceedings, some of which had previously been presented. He would have reopened the actions already completed only to apply the standard text again, which, according to the Court, has artificially inflated its productivity indicators.

Judging in series compromises impartiality?

The judgment of the case was emitted by the special body of the TJ-GRS, made up of 25 judges, who considered the practices a violation of the principles of legality and impartiality. The decision involved the application of the maximum penalty provided for by the law on organic judiciary (Loman), based on article 42: dismissal.

The magistrate was in office from 1 July 2022, but was prevented removed in September 2023, when the suspicions earned strength. Since he continued to respect the test phase, he had no effective link with the court.

The defense of the judge, commanded by the lawyer Nilson de Oliveira Rodriguesdisputes the punishment. For him, the measure was “disproportionate“AND”Lack of deception or bad faith“. He appealed to the National Council of Justice (CNJ), asking for the revision of the sentence.

The defender says that the magistrate has taken on an overwhelmed civil rod, without an initial judge for years. “In this scenario, he tried to correct the operating failures, tidy up the procedural flow and promote administrative improvements, facing internal resistance that ultimately served as a catalyst for the disciplinary process“, Rodrigues said.

Before entering in office to Rio Grande do Sul, Angelica acted as a judge to pernambuco for almost six years. The appointment in the South took place after approval in a new competition.
