SAO PAULO AND BRASILIA – A House of Representatives approved, this Tuesday 6, with 260 votes against 83, the basic text of the bill which extends by six months the deadline within which consumers can request access to the network at the time of installation Solar Panel to produce their own energy, no longer paying transmission and distribution bills. The deputies will now analyze the main points, the requests to change the approved text. The six-month extension was the result of an agreement between the leaders of the Chamber, given that the original text provided for a one-year extension.
The costs for the use of the transmission and distribution systems not borne by those who have distributed generation systems are shared among the other electricity consumers, ie weighing on the other energy consumers. According to the calculations of National Electricity Agency (Aneel)the subsidies are expected to amount to R$5.4 billion for consumers in the country in 2023.
Theoretically, consumers who generate their own energy would be subsidized as they would no longer be using external facilities. Although, as EstadĂŁo has shown, basically everyone uses these networks at some point in the day, as they are connected to distribution networks and are not powered 100% or entirely by the solar energy they produce. Nonetheless, the law exempts these consumers from any type of transmission and distribution charge – which consequently means that all other consumers, especially those who cannot install their own systems, pay the transmission and distribution bill. .
The text modifies the regulatory framework for microgeneration and minigeneration (law 14.300), ratified in January this year by President Jair Bolsonaro (PL). The law stipulates that projects that submit applications for access to distributors by January 6 will remain exempt from paying wire use and charges until 2045.
For those who apply for installation after January 6, 2023, there is a smooth transition period until they start paying all the fees. The transfer starts from 15% in 2023 and gradually reaches 100% in 2029. These costs will be borne by consumers through the Conto Sviluppo Energetico (CDE), a sectoral fund used to finance subsidies for various segments.
However, the law establishes that this quota referring to the concession for these consumers during the transitional period will be paid only by consumers served by distributors, such as residential ones. Whoever buys energy on the free market will not participate in this distribution.
Based on the new six-month deadline, the Brazilian Association of Electricity Distributors (Abradee) has updated its estimates of the bill’s impact on electricity bills by 2046, which now stands at R$118 billion , compared to R$ 159 billion previously estimated.
