The case of Daniel Alves allegedly took place in the early hours of December 29-30, at the Sutton nightclub in Barcelona. As reported by the newspaper ABC and played by sports world, the 39-year-old right-back put his hand in the underwear of the woman who made the accusation. He sought out his friends and security at the club after the harassment.

The nightclub’s security team called the Catalan police (Mossos d’Esquadra), who took a statement from the victim. He also underwent a medical examination in a hospital. Daniel Alves left the scene before police arrived.

According to the Spanish press, cameras from the establishment show Dani Alves and a girl going to the toilet. About 47 seconds later, they both leave the scene. Then the player and his friends leave the club. The woman starts to cry, she is supported by her friends and she claims to have been sexually harassed by the athlete.

Robinho

In January 2022, forward Robinho was tried and ultimately sentenced to nine years in prison in Italy for raping an Albanian woman in 2013 while playing for Milan. According to the investigation and sentence by the Italian court, the Brazilian and five friends raped a young woman in a dressing room of the Sio Café nightclub in Milan, where she was celebrating her birthday. The player stated that the entire relationship he had with the informant was consensual and stressed that his only regret was that he was unfaithful to his wife.

In an interview with Stage, the victim’s lawyer, Jacopo Gnocchi, revealed at the time that he could have sought payment of around BRL 400,000 (€60,000) in non-pecuniary damages, but chose to wait for the prosecution to proceed. In his opinion, the Milan court that sentenced Robinho did a correct analysis of the case.

Transcripts of court-authorised wiretaps reveal that Robinho revealed that he participated in the act that led a young woman of Albanian origin to accuse the player and friends of gang rape, in Milan, Italy. In 2017, the Italian justice relied mainly on these recordings to sentence the aggressor in the first instance to nine years’ imprisonment.

In addition to the telephone recordings, the Italian police installed a wiretap in Robinho’s car and managed to capture other conversations. For the Italian Justice the talks are “self-accusing”. The taps show a dialogue between the player and a musician, who played at the club that night and warned the athlete of the investigation.

Robinho and his friend Ricardo Falco, also under investigation, were convicted under article “609 bis” of the Italian penal code, which speaks of the act of non-consensual sexual violence forced by two or more people, forcing someone to have sex due to their “physical or mental” inferiority condition.

Robinho’s lawyers say the athlete did not commit the crime he is accused of and argue that there has been a “misinterpretation” in connection with court-authorised intercepted conversations, as some dialogues were not translated correctly into Italian language.

Cuckoo

A successful manager in Brazilian football, Cuca was the subject of controversy even as a player. In a 1987 case, in Bern, Switzerland, the then Grêmio midfielder was arrested with fellow athletes Eduardo Hamester, Henrique Etges and Fernando Castoldi, on charges of having “sexual acts with addicted people” with a 13-year-old girl years.

The youths remained in prison for 30 days. Cuca denies any involvement. Eventually he was sentenced to 15 months in prison and paid $8,000.
