Sambistas requires violation of the brand since 2010

A dispute that involves the rights of the brand in the Brazilian music scene can stop in court. The Clareu group, known in the Samba scene since 2010, has released an official declaration Tuesday (8/7) which expresses the repudiation of the choice of the new tour of the singer Ivete Sangalo, entitled “Ivete Clareu”.

The central accusation of the Sambistas is that the name “Clareu” is already legally recorded by them at the National Institute of Industrial Property (INPI), which guarantees the group of use of exclusivity in the category of music and entertainment.

The declaration, signed by the press office of the Carioca Group and the legal consultants, states that Ivete Sangalo has not sought the authorization or started any negotiation before using the name on his tour. According to the note, the choice of “Ivete Clareou” can confuse the public and lack compared to the band’s trajectory in the National Samba.

In addition, according to the text, the Clareu group tried to resolve the situation in a friendly way, looking for direct dialogues with the team of the singer Baiana.

However, there was no agreement. Instead, the group’s legal advice states that the Ivete team has even submitted the recording requests “Clareu” and “Ivete Clareou” with Inpi, using the same classification in which the group already has the right to exclusivity.

In the declaration, the members of Clareu affirm that this attitude represents a violation of Markling’s rights and can configure unjust competition. They classify the episode as a gesture of lack of respect for history built on more than a decade in Brazilian music.

“It is an affront to the legitimacy of our work. Clareu is more than a name, it is an identity obtained with the effort and cannot be appropriate from third parties,” says an extract from the official position.

The group also stressed that it is adopting all the appropriate measures, both administrative and judicial, to safeguard their legal rights. The dispute can evolve into action in civil and criminal spheres if the artist’s team insists on the use of the brand without permission.

Ivete Tour has already announced dates and tickets for sale

The “Ivete Clareu” tour was announced in June and promises to honor Samba and the singer Clara Nunes. Presentations should take place in the city such as Sao Paulo, Belo Horizonte, Rio de Janeiro, Salvador and Porto Alegre. Tickets began to be sold Tuesday (8/7), the same day when the Clareou group published their repudiation note.

Ivete Sangalo’s team has not yet officially commented on the case. The space remains open for the event. In the meantime, legal developments are still strictly monitored by fans and experts in intellectual property.
