Prosecutors remove the surcharge and Alec Baldwin should not be arrested for shooting on film

While he still faces manslaughter charges, Alec Baldwin will no longer have to fear a five-year prison sentence for the fatal murder of “Rust” cinematographer Halyna Hutchins.

The 64-year-old actor also faced, up to this Monday, an aggravation of charges for use of a firearm, which can be punished with five years in prison. Prosecutors then removed that circumstance “to avoid further distractions” in the case.

“In order to prevent further distractions against Mr. Baldwin and his attorneys, the District Attorney and Special Counsel have removed the firearm enhancement from the manslaughter charges in the death of Halyna Hutchins on the set of the motion picture ‘Rust,'” said Heather Brewer, spokesperson for New Mexico Chief Justice Mary Carmack-Altwies.

On October 21, 2021, Baldwin fired a gun that was not supposed to contain live bullets on the set of the movie ‘Rust’, a ranch in New Mexico, Southwestern United States, resulting in the death of 42-year-old manageress of photography Halyna Hutchins. The shot also injured director Joel Souza.

Baldwin is under investigation by New Mexico justice for manslaughter, but escaped the worst sentence. He can still be sentenced to 18 months in prison, as can the gunsmith of the production, Hannah Gutierrez-Reed.

The actor claims his innocence. He assures that he was given a gun that was not supposed to contain real bullets and denies pulling the trigger. The revolver would have fired itself, which experts questioned.
