Sheik claims financial hardship to negotiate condo party fines

The former footballer’s lawyer argues that the amount charged is too high, as part of the fines would have been paid by the athlete at the time

Former player Emerson Sheik’s defense told the court that he is experiencing financial difficulties, in response to a request for BRL 140,000 to pay off a debt with the apartment building he lived in in an upscale neighborhood of the city of São Paulo. The lawyer representing him, Ricardo Omena, has also asked for a counter-proposal to negotiate the amount, since, according to his request, the amount charged is too high and undue.

The trial was opened after neighbors sued the current SBT commentator, claiming they suffered several inconveniences due to the parties promoted by Sheik at the time he lived in the development. In an interview with EarthOmena argues that some fines have indeed been paid, but that many of them were paid at the time.

“So there are fines [do processo] charged twice. In parallel with this, there are other important situations. The Sheikh, while the dates mentioned, 2018 and 2019, played at Ponte Preta, therefore it was not on the property, which [à época] it was leased,” he says.

According to the attorney, a well-known sports figure and another tenant, whose identities have not been disclosed, lived in the property during the time of the allegations.

“There are lawsuits he has filed against these people charging these sums. Lawsuits won, with liens, even on the assets of these parties,” the defense argues.

Again according to Ricardo, in the conciliation proposal the former athlete would have offered R$ 50,000 to close the trial. «The amount offered was already high and he offered it because he wanted peace, to end it all. The amount requested for the condominium [R$ 140 mil], however, does not consider reasonableness. Our goal is to resolve the situation.”

Judicial battle with condominium

The former footballer is experiencing a legal battle against the condominium in which he has an apartment, in the province of Pompeii, in San Paolo. In early 2023, the show’s commentator SBT arena he offered to pay BRL 50,000 to finish the trial, but there was no deal.

The legal dispute began in 2021, when the condominium filed an appeal asking the former Corinthians athlete to pay R$ 112,000 in fines. The warnings have been enforced in recent years, with the sheikh present in the residence.

According to reports from residents, the world club champion violated the law of silence with the parties he often promoted during the night. In the lawsuit is an allegation of sponsoring a party that ended at 6:20, with “loud music, shrieking laughter, shuffling furniture, screaming and singing.”

The condo even claims that when some residents reached out to Sheik to complain, the party escalated even more. “The noises have gotten worse,” the condo says. On some occasions the festivities ended only when the Military Police were called, as reported in the lawsuit.
