The Federal Court partially suspended, this Saturday (29/4), the injunction that had led to the temporary suspension of the Telegram application in Brazil. Judge Flávio Lucas, of the TRF2, said that the original determination is “unreasonable”, considering that it greatly affects the freedom of communication of people unrelated to the facts under investigation.
The decision, however, maintained the daily fine of R$ 1 million, which was applied in the first instance for failure to comply with the determination to provide data on neo-Nazi groups and channels in the application.
Flávio Lucas’ decision highlights the insufficient regulation of social networks in Brazil and the need to establish clearer and more specific rules to prevent abuse and protect both society and users. He argues that it is necessary to balance individual and collective rights, weighing the relevant constitutional interests. Furthermore, the judge recalled Telegram’s previous clashes with the Judiciary and said that tech companies must understand that cyberspace cannot be a free and distinct territory, but a space with rules that serve social purpose and evolution, not to back down.
