Gugu Liberato’s will will no longer be changed even if the stable union with Rose Miriam is recognized. Find out the details!
The struggle for the legacy of Gugu Liberated, died in 2019 at the age of 60, gained a new twist this Tuesday (20). According to information released by Splash, from UOL, the Supreme Court of Justice (STJ) validated the will signed by the presenter in 2011, where he allocates his assets to his children and grandchildren and leaves Rose Miriam, socially presented as his wife, with no right to nothing.
Minister Nancy Andrighi’s decision is due to a request for a special appeal, made by the team defending Rose. The doctor’s lawyers have asked for a review of the will left by the presenter.
According to the information found by Splash, with the STJ’s decision, the structure of the will signed by Gugu will not be changed even if Rose manages to demonstrate a stable union with the presenter, something he fights for in court.
It is worth emphasizing that the STJ’s decision does not extinguish the stable partnership recognition process, the next hearing of which will be held on the 22nd, it just means that its outcome does not change the entries in the 2011 will.
There is still the possibility that Rose will get part of the sum intended for the children, but the configuration foreseen if the will were canceled and the stable union with Gugu was recognized (50% for the wife, 50% for the children and nothing for the grandchildren) is not another possible scenario.
According to information disclosed by Veja magazine, the lawyer representing Rose and Gugu’s daughters, Nelson Wilians, will appeal the decision. The practitioner argues that the STJ’s decision exposes legal uncertainty. “If it was the intention of the presenter Gugu to leave 25% of the total, he would have tested 50% of the part available to his grandchildren and not 25%,” he told the masthead.
WHO HAS THE RIGHT TO THE LEGACY LEFT BY GUGU?
The will signed by Gugu in 2011 provides that each of the children, João Augusto, Mariana and Sofia, will receive 25% of the inheritance, thus totaling 75% of the assets destined for the so-called necessary heirs.
The remaining 25% was divided between the presenter’s five grandchildren: Alexandre, André and Amanda, sons of Amandio Liberato, and Rodrigo and Alice, sons of Aparecida Liberato. Finally, Gugu’s will also provides for a life pension of R$ 163,000 for Maria do Céu Moraes, the communicator’s mother, currently 93 years old.
Outside the list of Gugu’s heirs, Rose allegedly signed a document in 2012 declaring she was a single woman. The doctor’s attorneys said she was depressed and had a “delusional paranoid condition” when she signed the document.
