Leticia Spiller wins legal battle against Google in Marcius Melhem case

The actress is asking for the removal of links to websites that led to an interview in which she spoke about the Melhem case

The actress Letizia Spiller, 50-year-old won another court case against the Google websitein an action that is linked to the actor’s case Marcius Melhem. The 19th Civil Section of the Rio de Janeiro State Court of Justice rejected Google’s request to clarify the appeal.

In 2021, Leticia Spiller filed a lawsuit against the company. She wanted to remove links leading to reports echoing her interview with her on Reclame na Play in 2020.

He said in the interview that Marcius Melhem would not be the only man in a position of power to harass women in the station (Globo), but that he would become “the martyr of the situation”. He came to his defense: “I met Marcius and he never seemed like a person who would do something so aggressive. He is a very dear person. It is difficult to receive such news from a dear person, with a good heart” , he said.

The action against Google, according to Spiller’s defense, was aimed at “protecting Letícia Spiller from biased and biased reporting regarding an interview that mentioned the alleged harassment in question.”

The site had raised flaws in the sentence and asked for the recognition of an agreement of the Second Section of the STJ (Superior Court of Justice) which deals with the invalidation of removal orders directed at search providers and the need to add to the passive pole of acts deemed offensive by those responsible for publications. But the court decided otherwise.

It is “irrelevant that Google does not host the infringing content,” according to the Civil Chamber judges. According to the decision, “the mere granting of access would be sufficient to verify the likelihood of the applicant’s right”. Google said it would not comment on the court’s decision.
