The Court of Justice of Rio de Janeiro has rejected the appeal presented by singer Eduardo Costa after he was sentenced to pay R$70,000 in moral damages after offending presenter Fernanda Lima on social media. The decision was made last Wednesday, the 6th.

The judge argued that, contrary to what the artist’s defense claimed, the original sentence contained no omissions or contradictions.

Furthermore, the judge found that the request made by the singer attempted to delay the trial without reason. Therefore, he decided not to change the decision and also imposed a fine equal to 1% of the value of the case on his compatriot. Now, parties involved in the process will be notified of that determination.

The case analyzed in the trial occurred when Fernanda was the presenter of the program “Amor & Sexo”, on TV Globo, in November 2018. On that occasion, Fernanda concluded the program with a speech on women’s fight against stereotypes. “They say a woman is crazy. The woman who defies the rules and doesn’t conform. They say a woman full of eroticism, life and lust is crazy. If we get fame, yes, we will stay in bed. We will sabotage the gears of this system of oppression,” he said.

After the speech, Eduardo called the host an imbecile on social media and said she ran a program for “criminals.” “More than 60 million Brazilians voted for Jair Bolsonaro and now here comes this idiot with this leftist speech,” he wrote on Instagram.

“You can be sure of one thing, the fight will end, the rope always ends on the weaker side and today you are on the weaker side. Do you create a program only for criminals, stoners, defeated leftists?”, he said.

A few days later, the singer apologized. “I was in the midst of emotion and I said things that I don’t mean, that I don’t like to say. I was an idiot, I was a real idiot. I regret it, I wasn’t satisfied with my words. I also want to apologize to Fernanda, his husband, her children and her fans,” Eduardo said.

The singer offered a settlement after the accident, with compensation of R$10,000, but Fernanda did not accept. The judge in the case, Eric Scapim Cunha Brandão, used the gender protocol of the National Council of Justice (CNJ) for the decision. According to him, the crimes have intensified the possibility of inciting a speech of violence against the presenter.

“The right to express one’s opinion does not renounce prudence, nor does it allow bad faith, thoughtlessness or irresponsibility, nor is it justified to offend one’s honor for personal reasons on social media, in particular when the author tries to deconstruct the gender violence that affects women in the most diverse ways in today’s society,” said Brandão.
