The Xuxa company will have to pay R$4.5 million for the improper use of comic characters

Xuxa’s company was ordered to pay approximately R$4.5 million to Minas Gerais businessman Leonardo Soltz for appropriating characters from The Cabralzinho gang, created in 1997 by the artist. On Wednesday 13th the decision of the Court of Rio de Janeiro was approved, in a process that has lasted 20 years. Xuxa’s consultant has been contacted, but has not yet responded; the space remains open.

According to Leonardo, the presenter’s company Xuxa Promoções e Produções used its characters in a special action to discover Brazil. According to Soltz, the characters in The Cabralzinho gang they were created in 1997. The publicist says he offered the characters to the producer in 1998, but has received no response to the offer.

A year later, in 1999, the Xuxa company was launched The Xuxinha gang on the 500th anniversary of the discovery of Brazilwhich the magazine also won The Xuxinha gang discovers Brazil. The compensation was calculated taking into account the circulation of the magazine, as well as the reproduction of the images and the earnings deriving from the use of the characters.

The decision also indicates the impact of the summons interest, the pecuniary correction, the procedural and legal costs and underlines that the sums obtained are not aimed at unjust enrichment. There is still appeal.

A Cabralzinho band was created by Soltz to celebrate the 500th anniversary of the discovery of Brazil, celebrated in 2000. The characters would be Cabralzinho, Bebel, Quim, Purri and Caramirim, and they would be the mascots of the discovery party.
