The court rejects the request of Edu Guedes in the action against Alexandre Correa

The judge Guilherme Rocha Olivaof the 38th Civil Court of São Paulo, rejected the request Edu Guedes in a defamation action against Alessandro Correaex-husband of Ana Hickmann.

The presenter was accused by her businessman of having an affair with her when they were still married. The chef also wanted Alexandre to be prevented from mentioning her name.

However, the refusal is not definitive. The judge orders that the first request from Edu’s lawyers be modified within 15 days, clarifying the facts and the reason for the request for material damage.

“There are no ‘material and moral damages’, but there must be facts, causes of action and separate requests for material compensation and moral compensation, or the waiver of one of them”, says the text.

The judge also underlined this “In principle (summary cognition), it is not possible to generally prohibit someone from talking about another person, which, in theory, would characterize preventive censorship and would be unconstitutional.”
