The video of the influencer Bel Ponciano throwing money from a helicopter on the beach of Balneário Camboriú, in Santa Catarina, has gone viral. On Sunday the 21st, he “rainted” R$10,000 in R$20, R$50 and R$100 notes and shook the place. But is throwing money on the street a crime? He can?

To the Earthlawyer specializing in civil law, Andrews Veras Ferruccio, of Posocco & Advogados Associados, explained that it is not a crime to throw money on the street.

“As long as the money is yours, throwing it on the street is not a crime. Since it is an own resource, the person can dispose of it or use it as he wishes, even throwing it on the street,” she said.

The lawyer cited, for example, the case of Silvio Santos who threw his money into the audience of his television show.

However, as he underlines, attention must be paid to the Criminal Code: “Tearing, damaging, rendering useless or destroying money, even if it is property, constitutes the crime of qualified damage”. This is because real banknotes or coins are public property.

Art. 163 – Destroying, rendering unusable or damaging other people’s property:

Penalty: imprisonment from one to six months or fine.

Single paragraph – If the crime is committed:

[…] III – on the assets of the Union, the State, the Federal District, the Municipality or the body, the public foundation, the public company, the mixed capital company or the public service concessionaire company;

Punishment: imprisonment from six months to three years and fine, in addition to the penalty corresponding to violence.

The case of the “money rain” in Balneário Camboriú

Last Sunday, the 21st, the influencer Bel Ponciano, who has more than 100 thousand followers on Instagram, flew over the Balneário Camboriú beach in Santa Catarina by helicopter and “made it rain money”, throwing banknotes from the sky.

“They said it was impossible, I went there and did it,” he said at the beginning of the video that captured the moment, shared on his social networks.




This isn’t the first time Bel has done something like this, nor the second. In January this year, he did the same thing, but threw the tickets out of the window of a building overlooking the street.

In February, another case, this time on Avenida Atlântica in Balneário Camboriú. He was traveling in the car while throwing the ballots out the window. I wait:
