The Justice of Rio de Janeiro sentenced the journalist Erlan Bastos, known from the Em Off portal and for having presented the “Balanço Geral Ceará” in the Record network, to compensate for moral damages of R $ 15 thousand to Marcos Pitombo (“Pride and passion” ).
The actor filed a lawsuit against Bastos after disclosing the false information that he was the pivot of the end of the relationship of digital influencers Gabriela Pugliese and Erasmo Viana.
The defense of Pitombo cites that Erlan posted on his Instagram profile a photo of the actor with Erasmus and a “caption with a tone of debauchery and irony”, as well as having posted a video on his YouTube channel on the subject in February of ‘ year. past.
Pitombo denied all gossip and demanded the deletion of the video in question, but it was only placed in private mode on the content platform.
In the ruling, judge Arthur Eduardo Magalhaes Ferreira stresses that the journalist was more concerned with “publishing gossip than verifying the veracity of information, the minimum care required of those who see social media as a means of survival”.
«Freedom of communication must be balanced with the individual right of each person, so that, without limiting the circulation of information, the crime is avoided at the time of the person involved in the news. However, in the specific case, the accused has spread news that, in fact, have not turned out to be true “, we read in an extract of the decision, which also underlines that Bastos can no longer mention the name of Pitombo in this case.
