Monark sentenced to one year and two months in prison for calling Dino “fat”

YouTuber Bruno Ayub, better known as Monkwas sentenced by the Federal Court to one year and two months in prison for insults committed against Minister Flávio Dino, of the Supreme Federal Tribunal (STF). The sentence also provides for the payment of R$50 thousand in compensation.

The decision was made by judge Maria Isabel do Prado, of the V Federal Court of São Paulo, last Thursday 3rd, as reported by the The globe. The conviction was based on a criminal complaint filed by Dino against the YouTuber, after an offensive broadcast made in June 2023.

At the time Dino was Minister of Justice in the government of Luiz Inácio Lula da Silva (PT). From the accusation of slander, defamation and crimes against honor it emerged that, in a podcast, Monark called Dino ‘fat’ and ‘son of a bitch…’.

“You are about to become a slave to a big fat boy. This boy alone will not last a second on the street, he can’t run 100 meters. Put him in the forest to see if he survives. Let this boy be your master? That’s why i Did your parents give you an education? Did they sacrifice themselves for you to serve this son of a bitch?,” the YouTuber said during the broadcast.

In the decision Prado rejected the defamation conviction, but underlined the crime of insult with facts proven “beyond any reasonable doubt”. Watch the excerpt:

“It is unequivocal that the sentences he passed were offensive to the dignity and decency of the victim, as well as that the defendant had the specific intention of insulting the plaintiff, which went beyond the scope of mere criticism,” he states the judge. .

For Prado, the right to criticism “is not intended to justify indiscriminate, frivolous, humiliating and irresponsible insults and accusations such as those made by the accused in relation to the decorum and dignity of the complainant, whether as a public agent or as an individual.”

The criminal complaint was suspended by Judge Fausto Martin de Sanctis, of the Federal Regional Court of the 3rd Region (TRF-3), but the proceedings resumed in March this year, following a collective decision of the court.

The YouTuber did not appear as a lawyer and ended up being represented by the Public Defence, which asked for the proceedings to be suspended. Monark will be able to appeal freely.
