The Court of Mato Grosso do Sul condemned Ana Hickmann, her ex -husband, Alexandre Correa, and former councilor to pay $ 30,000 in compensation for moral damage to a journalist. According to TJMS, the journalist was accused of being the author of threats against the presenter and was “unduly and prematurely”. The case is to appeal in the second instance.

The process was developed since 2021 in the Campo di Campo Grande and had already been sentenced by the 14th civil court. However, all the parties appealed to the decision and, last Monday, 17, the 5th Civil Chamber of the Court denied the appeals against the sentence, keeping the indemnity for the actor.

According to the court, the boy was still a journalism student and recently had taken the position of a contract for a bank employee. At the time he lived in the city of sound, inside the state, and was surprised by the calls of a classmate and a teacher who told accusations on him in the media.

The article claimed to be a profile administrator on a social network, which published the presenter’s CPF and published death threats against her. The site would also have published that the student would use his bank role to obtain data reserved by Ana.

Also according to the Court, the publication was also published on the presenter’s blog and reproduced by about 53 sites, as well as TV programs, together with the journalist’s photo, who at the time was also an intern in an issuer.

In the action, the journalist requested compensation for moral and material damage, considering that the accusations of harassment and threats, among other crimes, were presumably based on a technical relationship prepared by a system at the request of Ana, Correa and the former consultant.

Appeal denied to the presenter

In the appeal, the boy’s defense said that the amount could not be less than $ 50 thousand, since they had been 13 years of facts, he was in psychological treatments and never restored his health, which is impossible to act in his training area, because his “image is still extremely compromised”.

In turn, according to the court, Ana stresses that there are three expert relationships in the file that indicate a possible participation in the development of the facts. The defense asked to reject the action or, alternatively, to reduce compensation R $ 2,000.

But the rapporteur of the case, the judge Geraldo de Almeida Santiago, said that the sentence must be maintained, since the case deals with the collision between the principle of freedom of expression and information and the principle of protection of the private sphere.

In the case in question, “the right to freedom of expression has been exercised in a disordered way, causing damage to the image, honor and intimacy of the author, so that compensation for the damage caused, since it undoubtedly suffered moral damage”. The vote was unanimous and decided to condemn Ana, the ex -husband and the former councilor. The three can still appeal secondly.

In a note a Earth, Ana Hickmann’s opinion said that the process is secret and that the procedural deadline for demonstration is currently in force, therefore, will appeal to the upper court.
