Justice allows Marcius Melhem to spread Dani Calabresa’s messages

The San Paolo judge on Wednesday (3/8) presented the criminal complaint filed by comedian Dani Calabresa against Marcius Melhem, former director of Humor al Globo.

The action aimed to ban Melhem from showing WhatsApp messages exchanged between them, following the complaint of moral and sexual harassment that she and seven other women have made to him since 2020.

The São Paulo Court of Justice has understood that it cannot prevent him from revealing something to defend himself, while the prosecutor takes the case to the press and publications, such as Piauí magazine, report complaints against him.

In a statement, the defense of the actress expressed regret for the permission to divulge the messages, comparing them to “leaks” that would have “the aim of damaging the reputation of informants”.

“Dani Calabresa’s defense regrets the decision, but respects it, as it did during the entire trial. We emphasize that the criminal investigation into the complaints filed by 12 women against Marcius Melhem for sexual harassment remains secret, as well as the lawsuit filed by the Public Ministry of Labor. The statement draws attention for citing the complaints of 12 women, a number that had never been filed until then.

Marcos Melhem’s defense also commented on the release of messages from his cellphone.

“The court decision demonstrates the correctness of Marcius Melhem’s conduct in defending himself against the allegations made by the lawyer of the group of eight informants in the press, without any investigation. It was not Marcius Melhem who first sought the press. as Justice intended, it only happened after the widespread attack he suffered publicly. Marcius respects Justice and the confidentiality of investigations and will always defend himself in every legal way to prove his innocence in the face of the lies told. The Melhem case came to light in December 2019, in a note by columnist Leo Dias. In March 2020, Grupo Globo’s compliance committee acquitted the comedian of the charges. Nonetheless, the company terminated the contract with the station’s then head of department, releasing a giveaway message about the professional in August.

In October 2020, the allegations against Melhem ceased to be rumors and took the weight of a complaint from a lawyer, Mayra Cotta, who presented herself as a representative of the women allegedly harassed on the pages of the Folha de S. Paulo newspaper. In December, Piauí magazine published the first report on the case, full of detailed information – some already dismantled – on Melhem’s cases of harassment against former employees, in particular Dani Calabresa.

The publication generated anger on social media against Melhem, who took legal action against the magazine, the lawyer, Calabresa and several comedians who called him a harasser.

It was only then that Melhem began giving interviews and presenting the messages exchanged with Calabresa as proof of his version of events. Messages presented to Folha and the Record network showed that the two had an intimate and friendly relationship between 2017 and 2019, a period in which, according to Piauí magazine, he allegedly morally and sexually harassed the actress.

Two days later, Calabresa’s defense went to court to prevent the spread of the texts and audio, and with a claim for non-pecuniary damage for Melhem for revealing private conversations. The accusation is that the actress was seeing her “dissolute intimate life”.

This Wednesday (3/8), Judge Fabricio Reali Iza, of the Special Criminal Court of Barra Funda, in San Paolo, rejected Calabresa’s request.

He accepted and agreed with the request of the State Attorney General for the presentation of the criminal complaint.

The deposit had also been previously recommended to the judge by the Public Prosecutor.

“He did so (the dissemination of the messages) only after being publicly accused by the offended party and his lawyer (Mayra Cotta) of the practice of serious crimes of moral and sexual harassment, in order to defend himself from the aforementioned”, says the report of the Public Prosecutor of the State forwarded to the judge, who accepted it.

The decision is final and cannot be appealed.
