Justice gives Antonia Fontenelle 15 days to pay compensation for moral damages

The Court of Justice of Rio de Janeiro (TJ-RJ) has established that Antonia Fontenelle should pay for compensation due to Giselle Itié within 15 days. The judicial determination was made official on Thursday (11) and provides for a 10% fine on the amount if the presenter does not comply with the deadline, in addition to another 10% for legal fees.

The cause originated after conflict between the two personalities in 2020, when Fontenelle published comments considered offensive against Itié on social networks. The actress had shared a report on the harassment suffered at the beginning of her career, in a declaration of support to Dani Calabresa, who had denounced Marcius Melhem.

In the publication made on Instagram, itié wrote: “23 years old. My first protagonist. I was seriously harassed and gagged by the director of the novel. To date I feel the pain of a silenced victim”.

Fontenelle interpreted the report as reference to the soap work “Start Out” (2004) and director Marcos Paulo, with whom he married. In response, the presenter published the comment that the Court has classified as xenophobic: “sad to know that there are women like you, give Giselle ité. Back to your country, it’s the best you do.” Itié was born in Mexico and came to Brazil as a child.

The first sentence, issued in 2024, set an compensation of R $ 50,000 for moral damage. The current value, however, already exceeds R $ 88 thousand, considering interests, monetary corrections and penalties applied, according to the information of the editorialist Ancelmo Gois, from the newspaper or globe.

The Bianca Nigri judge, head of the sentence, highlighted in the decision: “[Antonia Fontenelle] Preferred several crimes expressed to the detriment of [Giselle Itié]including xenophobic. “The magistrate also said that there were no evidence that the actress had mentioned Marcos Paulo:” The author, at no time, reported to Marcos Paulo, indicated the name of the television network, of the soap opera, of the character who would stage or indicated any other information element that would conclude that he was referring to Marcos Paolo. “

In addition to the civil proceedings, itié presented a police relationship against Fontenelle for racism and xenophobia. The actress’s lawyer declared in 2021: “The crime of racism occurs every time you practice acts that aim to deny the rights both by color, origin, religion. Rights that are of everyone.
