The Court of Goiás ruled that WePink, a cosmetics brand owned by the influencer Virgínia Fonseca, is prohibited from organizing promotional lives until it demonstrates that it has sufficient stocks to deliver all the products sold by the promised deadline.

According to the decision of judge Tatianne Marcella Mendes Rosa Borges Mustafa, the fine for non-compliance is R$100,000 per event. The ban includes live broadcasts and advertising campaigns for virtual sales with the participation of Virginia Fonseca and other partners Thiago Stabile and Chaopeng Tan.

The judge underlined that the measure was adopted due to “abusive commercial practices and repeated violations of the Consumer Code”, as well as an “alarming and growing number of complaints” against the company. According to the Public Prosecutor, the complaints concern delays in deliveries, lack of refunds and failure to respect offers made during promotions.

The decision also imposes a number of obligations on WePink. The company must establish, within 30 days, a human, non-automated service channel accessible via telephone and other means, with a mandatory initial response within 24 hours.

Furthermore, the brand will have to publish clear information on consumer rights and cancellation, exchange and refund procedures on social media and on the official website, with defined deadlines. Failure to comply with these obligations may result in an additional fine of R$1,000 per incident.

Another decision requires WePink to resolve cancellation and refund requests within 15 days of the customer’s request. The judge also ordered the company to submit a comprehensive report with all complaints received since it began operations.
